Affordable Pittsburgh Bankruptcy Lawyer

Dealing with the problems like default payment, overdue bills, missed mortgage payments, harassing calls, etc., is not easy. If you are in a financially tight spot where these things have become a part of your life, then you need to start considering filing for bankruptcy. Even though there are many negative ideas that you might have regarding the bankruptcy process, you will be amazed to know that it can offer you some really unexpected benefits. Connect with our Pittsburgh bankruptcy lawyer today to enjoy those benefits. Why You should Hire a Lawyer?

The bankruptcy procedure is formidable. During the initial consultation, the lawyer will first educate you about the process and help you deal with the anxiety of the process. When you are coming for a consultation from our Pittsburgh bankruptcy lawyer, we will ask you some questions that will give us a clear picture about your financial situation, why bankruptcy is the ideal solution for you and your financial goals from it. Our object is to help you understand the bankruptcy process clearly while getting to know the benefits of each chapter of bankruptcy.Chapter 7 Bankruptcy in Pittsburgh

Filing for chapter 7 bankruptcy will be the ideal solution for you if you don’t have any regular income, no substantial assets and mostly unsecured debts including credit card bills or medical bills. This is a short process that allows the debtor to eliminate most of your debts.

Chapter 7 bankruptcy is popularly known as liquidation bankruptcy where the court-appointed trustee will liquidate most of the assets to pay off the debt. Even though this sounds dangerous, you can still save most of your properties and assets.

When you are filing for Chapter 7 bankruptcy, you will get a chance to opt for state and federal exemptions. These exemptions are designed to protect your assets and properties. While the state exemptions offer protection on your income, the federal exemption can save your house and car. The majority of chapter 7 bankruptcy cases become no asset case where our Pittsburgh bankruptcy lawyer successfully help the debtor save the assets and wipe off the debts.Chapter 13 Bankruptcy in Pittsburgh

If you have more disposable income and you are aiming to pay certain kinds of debts including mortgage arrears and back taxes, then chapter 13 bankruptcy will be your ideal solution. The heart of this bankruptcy filing is the court-approved repayment plan that will help you restructure your debt payments. The calculation of the monthly disposable income will be used for creating the plan that will help you catch up with the debts. Often the calculation doesn’t require you to pay the unsecured debts. This way you can get a time window to restructure your debt situation.

At Pittsburgh Bankruptcy Law Group, we have handled plenty of cases for both chapter 7 and chapter 13 bankruptcy filing. Our Pittsburgh bankruptcy lawyer is experienced enough to help you with these cases. Also, keeping in mind your current financial situation, we ensure not to make you more financially burdened. Hence, we offer a much affordable rate. Come to us for a free consultation.

Rape 18 Pa. C.S.A. § 3121

If a person is the victim of forceful sexual intercourse without their consent, it is called rape. The following scenarios might be involved:

Sexual assault is a broad spectrum term that covers many other nonconsensual sexual acts apart from rape. The statute reads:

“a person commits a felony of the second degree when that person engages in sexual intercourse or deviate sexual intercourse with a complainant without the complainant’s consent.”

Sexual assault is a second degree felony offense. There are also different provisions including people related with sports, volunteer workers and employees of a nonprofit organization.

Indecent Assault Pa. C.S.A. § 3126

The assault is done with indecent and lewd gesturing and the contact with genitals or bodily fluid happens, this will be considered as indecent assault.

The act is done without the consent of the victim

The victim was forcibly compelled

The victim was under threat

The offender has used alcohol or drug to make the victim unconscious or with impaired judgment

The victim was unconscious

The victim was a minor, bellow 13 years of age

The victim doesn’t have the mental faculty to consent

Penalties for Sexual Assault

The penalties of sexual assault can be diverse depending on the severity of the crime. If it is a first degree felony, the offender gets 20 years of imprisonment and $25,000 fine. In the case of second degree felony, it will be 10 years of jail time and a fine up to $25,000. Third degree felony will mean that the convicted will get 7 years of jail time and $10,000 fine.
A restraining order is known as protection from abuse order in Pennsylvania. This order is governed by Protection from Abuse Act 23 PA.C.S.A. §§ 6101-61119. The main aim of the order is protecting one party from domestic violence and control over the contact between the plaintiff and the defendant. When you have been notified that a PFA order has been issued against you, you need to get in touch with an experienced Pittsburgh PFA lawyer. Come to Logue Law Group so that we can fight for you.

When it comes to the type of PFA orders, there are three types of it.

When the situation turns out to be emergent and the Court of Common Plea is closed, this order is issued by the on-call magisterial district judge and will last for one business day.

This type of order is known as ex parte order. This order gets issued right after the validity of the emergency PFA order is over. This gives the plaintiff protection till the trial. This order is issued by the court and can be valid for five to ten days. For this, the defendant doesn’t get a chance of defense. The order will be based on what the petitioner has claimed.

A full PFA order can last up to three years. It is passed by the judge of the Common Court of Pleas. The plaintiff and the defendant both must be present in the trial. This is the only chance that the defendants will get to defend themselves.

Emergency PFA Order

Temporary PFA Order

Full PFA Order

PFA Order- Qualification and Consequences

There are a few qualifying factors depending on which PFA gets issued. If it is issued in false pretense, then the situation can be dire.

Against Whom the PFA Order Can be Filed?

PFA order can be obtained against the following people:

Former or current spouse

Former or current sexual or intimate partners

Household members related by blood and marriage

Parents and children

Same sex couples

If the petitioner is minor, then an adult person will be needed to file the petition. Neighbors, coworkers, room and class mates are not the people against whom one can file a PFA order.

Things to be Proven for Issuing a Permanent PFA Order

The evidence of the abuse should be sufficient enough so that the court decides that issuing PFA order is the most logical way to protect the plaintiff from abuse. The following forms of abuse will be considered eligible for the PFA order.

Sexual abuse

Physical abuse

Stalking

Threats that will make the plaintiff believe that he or she is imminent danger

False imprisonment where the defendant keeps the plaintiff in a place against their wish

Consequence of PFA Order

For starters, the defendant will not be allowed to go near the plaintiff. Also, the following things can happen:

Removal from the house shared with the petitioner

Loss of constitutional and parental rights

Paying the fees for PFA

Public court record of the PFA order

Even though the PFA order is a court order, the defendant might face other criminal charges that will result in penalties.

Expungement of a PFA Order

There are only two situations that can lead to the expungement of the PFA order:

If the petition for the PFA is dismissed

The permanent PFA order was never issued owing to the withdrawal of the request

If the permanent PFA order is issued, it cannot be expunged from the public records.

ChildLine is a part of Pennsylvania’s Department of Public Welfare. The main aim of this registry is the protection of the children from abuse and neglect. Even the bystanders can call the toll-free number about the suspected child abuse case. If the allegation seems to be a plausible one, then the ChildLine and the General Protective Service will launch a countrywide program to gauge the danger of the children abused in a similar way. The accused of the alleged abuse or negligence gets notified that their name has been included in the registry for child abuse.

The consequences of this can be severe. If your name is included in the registry, then you will be prohibited from the jobs that involve minors in social, professional or private settings. If you are a parent and your name is listed in the registry, you will be prohibited from getting into activities involving your child. The same can happen if your business employs children in any form.

The attempt of this is noble. But it is often misused. Your name might be included in the same list with pedophiles and actual child abusers. That is why often civilians claim that the inclusion of their name in this registry is actually a disservice for them from the department, especially when they are not abusers or neglectful towards minors.

The Process of ChildLine Appeal

If you are facing the allegation as per the ChildLine, then you get a specific period of time for appealing so that the allegations can be expunged. This will mean that the name of the alleged abuser will be removed from the registry and all the related documents will be expunged too.

Once you get notified about the allegation, you need to appeal immediately within the given period. Once you submit your appeal, the hearing officers will revisit the facts of the case as per your request. The accuser will need to present plausible evidence for these allegations. Otherwise the case will be dismissed.

Consult Pittsburgh domestic violence lawyer

If you have been notified by ChildLine that your name has been included in the registry, then don’t panic. Before anything else, give our Pittsburgh domestic violence lawyer a call. Logue Law Group is here to help you.

Washington PA Nursing Home Abuse Lawyers

If you or a friend or family member is interested in more information concerning a nursing home abuse case, contact Logue Law Group at 412.387.6901 in order to talk to one of our experienced and dedicated injury lawyers.

Unfortunately, nursing home abuse is all too common in our country. Elderly people in these homes can be taken advantage of and neglected in several ways. These acts are unacceptable and happen far too often as well as, unfortunately, going unreported a lot of the time. Due to a fear of being punished in some way or not being believed, many elderly patients do not report their abuse. Between 1999 and 2001, almost one-third of all nursing home facilities were cited for violations of federal standards that could cause harm, or that did harm elderly residents of those facilities according to Nursing Home Abuse Guide.org. Even with this high number being reported, consider the fact that a large number still goes unreported. Nearly 10% of those homes that had violations that posed a risk of serious injury or death, or that did cause deaths of elderly residents.

Fortunately, we can help to look out for these patients who tend to be defenseless or at least feel that way. There are certain warning signs to watch for in elderly patients who may be experiencing abuse or neglect, including, but not limited to:

Unexplained injuries

Bruises

Bed sores

Lacerations

Multiple falls

Over or under medication

Poor hygiene

Malnourishment

Weight loss

Dehydration

Fearful statements or refusal to comment at all

Not only are the homes themselves liable, but so are the CNAs (certified nursing assistants) and RNs (registered nurses) that are employed at those homes. More than half of all Certified Nursing Assistants (CAN’s) in elder care facilities have admitted verbally abusing, yelling at, and using foul language with elderly residents of care facilities and Research from 2010 indicates that up to half of all nursing home attendants have admitted abusing or neglecting elderly patients. These high numbers show that this is not just a small number of incidents occurring, but a staggering amount of incidents involving elderly patients in nursing homes.

These patients living in these homes have a right to be treated with respect and dignity and that cannot be ignored due to their age or their physical or mental state. Each patient has the right to proper hygiene and nutrition and must be treated in a respectful and appropriate way. Often times those who suffer from this abuse have a higher rate of dying prematurely and many feel as if they cannot talk to anyone concerning these problems.

If you even suspect some type of nursing home abuse or neglect, please take the time to call Logue Law Group at 412.387.6901 to speak to one of our attorneys who only wishes to help you and your loved one and to make sure they are treated with the respect and dignity that they and all the other patients deserve.

When you hear about kidnapping, the image that probably comes in mind is stealing and keeping children against their will. Yes, this type of incident happens. However, the more realistic example of kidnapping is one of the parent simply thinking that they can care for their child better and violate the custody order by keeping the child with them.

If you have been charged with kidnapping, then connecting with a Pittsburgh domestic violence lawyer will be helpful for you.

What is Kidnapping?

The definition of Kidnapping can be varied in Pennsylvania. There are number of ways that can prove that a person might be guilty for the crime.

Kidnapping

When a person removes another person “substantial distance under the circumstances from the place where he is found,” or they illegally confines a person for a long time in isolation, it will be considered as kidnapping. This might include:

Holding the person for ransom or reward

Helping in fleeing from felony or fleeing from felony

Inflicting bodily injury on the person or terrorizing them

Interfering government and public officials to perform their duties.

Kidnapping can be a first degree felony when these circumstances are involved.

Unlawful Restraint

This can happen when a person:

Restrains another person illegally while exposing them to the risks of bodily injury.

Holding someone in the condition of involuntary servitude

When committed against an adult, this is a first degree misdemeanor and when the victim is a minor, it is a second degree felony.

Interfering with the Custody of Children

When someone is taking the child ignoring the custody order from their parent, legal or local guardian

or supervisor, it is considered to be an interference with the custody of children. This is a third degree felony. However, if the defendant doesn’t know that it can pose a serious threat to the child, this becomes a second degree felony. If the following incidents happen, then the crime will be a second degree felony:

The defendant did it in good cause

The time is less than 24 hours

The defendant has the partial custody of the child

Penalties of Kidnapping in Pennsylvania

The penalties will vary on the types of offenses and the situations involved.

First-degree felony: A first-degree felony is punishable by up to 20 years of jail time, and fines up to $25,000.

Second-degree felony: A second-degree felony is punishable by up to 10 years of jail time, and fines up to $25,000.

Second-degree misdemeanor: A second-degree misdemeanor is punishable by up to 2 years of jail time, and fines up $5,000.

Example of Kidnapping

There are various scenarios that might lead to kidnapping charges:

The defendant takes the child away from a parent and remove them from the state

The defendant takes the child away from the other parent who has the primary custody of the child

If the defendant has joint custody of the child and they break it by taking them away

Preventing parents’ access to a child

If you are taken into police custody for a criminal offense, you will immediately find yourself at the mercy of the legal system, and you will probably be feeling confused, less than human, and without hope. Your best chance to maintain your freedom is to make use of your right to remain silent and hire one of the experienced Pittsburgh Criminal Lawyers from Logue Law Group. Our Pittsburgh Federal Criminal Lawyer will explain your charges in detail, as well as the procedures that will be followed in your case. He or she will discuss the defense strategies that fit your case the best, and protect your rights as you go through the criminal law process.

It can be difficult to choose the right lawyer for yourself or a loved one. You need someone who is experienced, trustworthy, and available immediately. You might also need to take into account the cost of the attorney’s services and your impression of his reputation and character. Speaking with the lawyer you think you’d like to hire will assist you in making an informed choice.

We can Get You Results

The most important things your lawyer should have are experience, skills, and a successful track record in the area in which you require representation. Though there are many factors that you must look at, there are none that, by themselves, can predict the success of your case or the quality of service your attorney gives you. Even experienced lawyers make mistakes that hurt their clients’ cases, and new, inexperienced ones sometimes are able to win an acquittal when all hope seems lost.

You can increase your chances of receiving the best possible outcome in court by hiring a lawyer who:

Has had success in winning similar cases to yours over the years

Graduated from a respected law school

Served as a prosecutor prior to turning his or her skills toward defending cases

Has received recognition and awards for their work

Has a good rating with attorney rating sites such as Martindale, Super Lawyers, or Avvo

Has at least a couple years of experience

Has never had to face disciplinary action

People are often tempted to call an attorney they know personally—either a family member or a friend—to represent them when they need help. You must make sure, if you do this, that your friend or family member has experience in criminal law, because the methods and procedures used in criminal law are different from any other area. An attorney who deals with wills and trusts might not be a good choice to help you fight a DUI.

Hiring a Great Defense Attorney from Logue Law Group

You will have to balance hiring a good attorney against the costs of his or her services. Being charged with a crime is expensive. If convicted of the charges, you may need to pay things like court costs, civil restitution fees, and fines. Then, even if you win your case, you must pay your attorney. at Logue Law Group, we generally charge a flat fee, which means you will be charged a single fee for our services. This makes it easier for you to budget. Hiring a lawyer is expensive, but worth the money when your family life, career, and freedom are at stake.

Trusting your Pittsburgh Criminal Defense Lawyer

You shouldn’t just blindly hire an attorney because he or she is affordable, hardworking, experienced, and smart. Criminal cases can be lengthy, particularly when an appeal is involved, so you should hire someone that you can trust, who you are comfortable with, and with whom you can have an effective relationship. Also, you need to know that your attorney will have your interests at the forefront of his defense and that he will vigorously pursue every option that might get you a good result.

Because every client, attorney, and case is different, you will need to go with your gut when hiring your Pittsburgh criminal defense attorney. The first time you talk to him or her, try to determine if he or she is really interested in your case and is a good listener. If you feel like the lawyer doesn’t have time for you or would rather discuss fees than your case, he or she may not be the best fit.

Why Choose Us?

at Logue Law Group, our objective is to gain positive case outcomes for our clients via personalized attention and aggressive advocacy. We strongly believe that we are capable of enhancing the chances of a successful outcome for each client by carefully listening to them, discerning what they need, and treating them like people and not merely case numbers. For the attorneys at Logue Law Group, treating our clients the way they should be treated and advocating for them and their interests as they go through the criminal justice system go hand in hand.

Our attorneys have an excellent track record of safeguarding the rights of people charged with various offenses, both criminal and traffic, in Pittsburgh. With their high level experience in representing their clients in all levels of the court system, our attorneys are capable of handling many different types of cases.
Harassment means that the defendant engages in a pattern of behavior where the plaintiff might feel fearful or they believe that they are in danger. From mere communication to threats and physical contact with the victim, anything can be considered harassment. This type of case is complex in nature and the police report is not always trustworthy. So, if you have been charged with a case of harassment, you will need the help of an experienced Pittsburgh domestic violence lawyer. At Logue Law Group, we have handled many cases involving harassment. We can help you too.

What is Harassment?

Defined under Pa. C.S.A. § 2709, harassment is a crime that involves two categories including harassment and cyber harassment of a child.

Harassment

The defendant commits harassment when they have the intention of harassing, annoy or alarm other people while performing the following acts:

Striking, shoving or kicking a person or attempt and threat of doing these

Following a person around public places

Repeatedly committing an act with no legitimate purpose

Communication with lewd, obscene, lascivious, or threatening words or drawings or caricatures

Communicating repeatedly with anonymous letter

Communicating repeatedly at inconvenient hours

Cyber Harassment of a Child

The victim of this crime is always a child. If the person with the intention of harassing, annoy or alarm commits the harassment using electronic and digital modes or social media, then it is known to be cyber harassment of a child. They can commit the following acts:

Communication with “seriously disparaging statement or opinion” about the physical characteristics of a child, sexuality and sexual activity, physical or mental health condition

Communicating a threat of inflicting harm

Penalties of Harassment Charges in Pennsylvania

The harassment can be summary harassment or even a third degree misdemeanor. In the case of summary harassment, the defendant can get 90 days of jail time and fines up to $300. If it is a third degree misdemeanor, then the jail time might be of one year along with a fine up to $2000. The penalties might get increased if the offender is violating PFA order or harassing the family members of the victim too.

Examples of Harassment in Pennsylvania

There are various ways one can commit harassment. Take a look.

Repeatedly attempting to contact the victim

Sending lewd content to the victim

Making several threats

Attempting or contacting at inconvenient hours like late night

Following the victim in a public place

Threatening a minor online

Sending sexual or disparaging content to a child virtually

Making physical contact with the victim with the intention of harm

In all of these examples, it needed to be proven in the court that the intention of the offender was wrong.

Defending Harassment Charges with Pittsburgh domestic violence lawyer

The severity of harassment is a bit lower than stalking. Also, the intent of the defendant plays the primary role of harassment. And that is why in the trial, defendant’s words and victim’s words can be used to prove that the defendant was the harasser.

You need to get in touch with a Pittsburgh domestic violence lawyer. Come to Logue Law Group and let us take care of your charges. For more details, give us a call.
