Driving Suspended 1543a and 1543b
Traffic Attorney Representing Pittsburgh Drivers
Driving a vehicle frees one from having to depend on others to move around. However, you need to bear in mind that a license to drive is only a privilege, and not your right. At any point, your driver’s license could potentially be revoked, canceled or suspended as a penalty for a traffic violation. Once suspended, further violating this suspension by driving while suspended is a serious crime and, in such a case, you would have to deal with an even longer suspension, hefty fines, or even incarceration. A Pittsburgh criminal defense attorney can help you fight these penalties. As per the law in Pennsylvania, there are two citations for driving with a suspended license:
- 1543 (a) – This section of the Traffic Code applies to any individual caught driving a vehicle while his/her license has been suspended, revoked or canceled. If convicted of this summary offense, the person may be sentenced to pay a fine of $200. Also, his or her license would be suspended for an additional year. Repeating this offense would cause a larger fine and a potential six-month jail sentence. Six or more convictions (or guilty pleas) for this offense means the person will be required to serve 30 days to six months in jail and pay at least $1,000 in fines.
- 1543 (b) – This section of the Traffic Code applies to a person who violates the suspension, revocation or cancellation of license due to a Driving Under the Influence (DUI) conviction in Pennsylvania. It would also apply to individuals who refuse to submit to chemical testing as part of a DUI arrest. It carries a mandatory fine of $500 and a jail sentence of 60-90 days for a first offense.
It is important to fight charges of driving while suspended to ensure that your driving privileges are restored. There are times when you can be erroneously charged for an offense that you didn’t commit. When your driving privilege has been suspended, there are legal remedies for license restoration. First, you need to fight the actual conviction, as well as the suspension, within 30 days. An experienced lawyer has a comprehensive knowledge base in regards to the legal proceedings or general laws of the state, and considerable experience in dealing with such cases.
