Fires can be one of the most traumatic types of injury and accident cases. When a fire occurs, it often destroys all of the physical objects in its path as well as the injuries it causes being long term and painful. Burn victims can also be prone to infections on top of the original injuries sustained making the whole experience extremely traumatic. When fires do occur, they can often be dangerous not only for burns, but also smoke inhalation and the danger of explosions occurring.

In fire and explosion cases, the claim is filed due to negligence or a product liability claim (such as a defective product). The parties responsible can include, but are not limited to:

  • Building managers
  • Architects
  • Contractors
  • Firefighters
  • Manufacturers of defective products
  • Distributors of defective products

Often times it is found that there is some type of malfunction, particularly found in faulty or improperly installed electrical equipment, but unfortunately, a lot of these cases go unclaimed and victims never receive compensation. According to the National Fire Protection Association (NFPA), firefighters respond to a structure fire every 63 seconds in the United States. Cooking equipment is the largest cause followed by faulty electrical equipment. Sometimes when a fire does occur, an explosion can follow and often times natural gas is the culprit. Especially in the home where many homes are heated using natural gas, when a fire burns hot enough an explosion can occur. In these cases, there is an even higher chance of injury even after a family may believe themselves to be safe outside.

As stated before, burns are not the only injuries that occur in fires. In the case of an explosion there can be other serious injuries including, but not limited to:

  • Loss of limb
  • Loss of vision or hearing (whether permanent or temporary)
  • Lacerations
  • Head trauma
  • Death

All of the above injuries can range in severity and require medical bills to fix. In these cases the victim may be entitled to help paying these bills as well as pain and suffering. There is also the case of smoke inhalation which can ultimately cause the formation of asthma or other respiratory infections and chronic diseases. The medical bills now and in the future may be covered in these cases for those problems as well.

While fireworks are illegal in Pennsylvania unless you have a permit, there are still many people who are able to purchase them (often from neighboring states) and set them off despite the dangers. When there is a faulty product or if it is illegally used or sold, then the person who set off a firework that caused an injury may be held responsible for the injuries caused. When a firework is faulty, the manufacturer and/or the distributor may be held accountable. When an injury occurs from firework use, it is important to contact a knowledgeable attorney to see if you have a case.

Because the injuries that occur due to fires and explosions can be so devastating, they often leave behind some type of scarring. Scars can be tough to live with due to the fact that they require extra attention in skin care (higher chances of sun burn and cancer-like diseases due to this fact), are more likely to be injured again, and are often either more sensitive or lack the presence of nerves. All of these things can be troublesome to an individual and sometimes the scar can simply be located in an obvious place that is either upsetting to the victim and may re-traumatize them or may affect their ability to do a job. When a scar is caused due to an injury that a party is found responsible for, there can also be cases for pain and suffering or compensation to help correct the problem. When filing a personal injury claim, scars alone can bring in upwards of $100,000 for the victim on their own.

In any case where a fire or explosion destroys property, injures you or a loved one or even causes death, it is important to have an attorney by your side to make sure that you get the compensation you deserve and that those responsible are held accountable so that these tragedies do not re-occur.
