Erie Bank Fraud Defense Lawyer
A disputed check, account withdrawal, or loan document can generate an investigation with a large volume of financial records. For someone facing bank fraud allegations in Erie, the defense should focus on the charged transaction, the defendant’s knowledge, and the institution’s legal connection to the case. Logue Law Group can review the accusation and help identify the questions that require an answer before any plea decision.
Understanding the two routes under § 1344
Federal bank fraud is governed by 18 U.S.C. § 1344. It covers knowingly executing, or attempting to execute, a scheme to defraud a financial institution, or a scheme to obtain property owned by or under a financial institution’s custody or control through false or fraudulent representations. The two statutory routes have different requirements: a charge under § 1344(2) does not require the same specific intent to defraud the institution required under § 1344(1). Counsel should identify the subsection charged and the proof needed for that theory.
The government must establish the applicable elements beyond a reasonable doubt. Counsel should also review whether the institution qualifies under federal law and what property or funds the alleged scheme concerned. The mere existence of an account transaction does not settle those questions.
Account access and the complete transaction history
Check images, account statements, deposit records, authorizations, communications, and access records can show how a transaction occurred. The review should distinguish ownership, permission to access an account, and permission for the particular transaction. A person’s job title or ability to log in does not by itself explain whether the alleged use was authorized or knowingly fraudulent.
- Compare the original documents with the versions investigators rely on.
- Identify who created, submitted, approved, or changed each disputed record.
- Check the sequence of deposits, withdrawals, reimbursements, and communications.
- Evaluate whether witness accounts match the financial records and the defendant’s actual role.
The appropriate challenge may concern knowledge, the alleged scheme, material representations, evidence reliability, or the institution’s statutory status. A defense must fit the facts rather than assume that every discrepancy is an innocent mistake or that every financial loss proves a crime.
Mortgage fraud and other financial charges
A mortgage allegation may require review of the loan application, supporting income information, appraisal or valuation documents, closing instructions, and the roles of brokers or other intermediaries. Bank fraud, false statements, mail fraud, wire fraud, and embezzlement have distinct requirements. Counsel should identify each charged offense instead of treating those labels as interchangeable.
Evaluating sentencing exposure
Section 1344 specifies up to 30 years of imprisonment and a fine of up to $1,000,000, or both. Those statutory limits are not a prediction of an individual sentence. The advisory Sentencing Guidelines, alleged loss, criminal history, counts of conviction, and federal sentencing factors require separate review. Restitution and other financial consequences may also need to be addressed. Multiple accusations do not automatically mean consecutive maximum prison terms.
Ask what facts a proposed plea would establish and whether the defense disputes loss, the alleged role, or other sentencing information. Trial preparation and plea evaluation both require a reliable understanding of the government’s evidence and the potential consequences.
