What a Pennsylvania PFA Case Involves

A PFA is a civil proceeding under Pennsylvania’s Protection From Abuse Act. The statute covers specified acts of abuse between people in qualifying relationships, including spouses, certain family members, current or former intimate partners, and people who share biological parenthood. Temporary Orders and the Final Hearing

A judge may issue a temporary order without the respondent present when the statutory requirements are met. The Act generally requires a hearing within ten business days after the petition is filed, although continuances can affect that schedule. At the hearing, the plaintiff must establish abuse by a preponderance of the evidence. The respondent has rights to counsel, to present evidence, and to compel witnesses to attend.

How We Prepare Your Defense

A useful defense starts with the details. We examine what is alleged, when it allegedly happened, who was present, and what available records show. Preserve original records and complete conversations, including material you believe is unfavorable. Do not edit messages, delete accounts, or contact someone to influence their account. Understand Every Restriction in Your Order

A PFA can restrict contact, possession of a residence, and access to children. Final protection orders can last up to three years and may be extended. The exact order controls what you may do while it remains in effect.

Firearm requirements need immediate attention. Temporary orders can include relinquishment requirements. Pennsylvania law requires specified firearm restrictions in final protection orders; final agreements are addressed separately by the statute. Federal law may also apply. Have counsel review the order, deadlines, and lawful relinquishment procedure before taking action.

Follow the order even if you dispute the allegations or the other person initiates contact. Do not assume an invitation, reconciliation, or return to living together cancels the restrictions. Ask counsel about requesting court clarification or modification before contacting the protected person, retrieving property, or arranging a child exchange.
