Erie PFA Questions for Victims
If you are seeking protection from abuse in Erie County, review eligibility, service, and the hearing process before deciding your next step. A judge may grant or deny relief. Filing a petition does not guarantee an order or physical safety. Call 911 for immediate danger, and discuss a safety plan with an appropriate support service.
These questions concern people seeking a PFA. For broader questions about participation in a criminal case, review our Erie crime-victim advocacy information. Private counsel must review potential conflicts before agreeing to represent you.
Is a PFA order the same as a restraining order?
“Restraining order” is often used as a general label. A Pennsylvania PFA is a specific civil remedy with relationship and conduct requirements. Erie County Courts provides separate information for protection from abuse, sexual violence, and intimidation. Review the court’s protection-order resources to identify the appropriate process.
I need protection from my abuser. What should I do?
For immediate danger, contact emergency services. For court relief, check current Erie County filing instructions, your eligibility, and the next hearing date. The main types of PFA relief have different purposes:
- Emergency relief: Short-term protection, if granted, with further steps needed to seek continuing relief.
- Temporary relief: A judge may consider a request without the other party present; the final case remains to be resolved.
- Final relief: Determined through the final-hearing process, with duration specified in the order.
The Erie County PFA office is at the county courthouse, 140 West Sixth Street, Room 225. Confirm current instructions before traveling. Bring a factual chronology, any existing order, and relevant documents you lawfully possess. Counsel can help organize the request and prepare for a hearing without promising approval.
How does a PFA order protect me from the defendant?
The signed order states the restrictions that apply. Do not assume every PFA contains identical conditions. Questions to review include:
- Which contact or location restrictions are included?
- What other conditions apply, and are there any exceptions?
- When does the order expire, and what steps remain scheduled?
If you believe an order has been violated, preserve relevant information and contact the appropriate authorities. Use emergency services for an immediate threat. Discuss enforcement questions with counsel; a lawyer cannot ensure that another person will comply.
Can I get long-term protection from my abuser?
A final PFA may remain in effect for up to three years. Both parties can present their positions at the final hearing. Check the actual hearing notice and order for dates and duration. Emergency or temporary relief does not eliminate the need to complete further required steps.
Keep hearing notices, messages, photographs, and a record of the source of each item. Do not alter originals, access another person’s accounts, or confront someone to gather evidence. Tell counsel about related criminal or custody proceedings so the consultation addresses their possible interaction.
