Monongalia County Criminal Record Sealing Lawyer

Logue Law Group reviews criminal record sealing questions involving Monongalia County, West Virginia, including matters connected with Morgantown. The starting point is the actual court record, the result of each charge, and the relief you want to request.

Start With the Monongalia County Court Record

For Morgantown matters, separate a Monongalia County criminal case from a university disciplinary proceeding or a federal case. Those records and procedures are not interchangeable.

Use the official West Virginia county court directory to locate current court information. Confirm filing instructions and any hearing location from the court and your lawyer; a directory does not decide whether your case qualifies.

Sealing Is Part of the Applicable Record-Relief Process

West Virginia does not offer a universal, separate “seal any conviction” procedure. In this context, sealing court records may be an effect of relief under an applicable expungement statute. The first question is whether the underlying case qualifies, not simply whether someone wants it kept private.

The distinction matters under section 61-11-25 for qualifying non-conviction matters and section 61-11-26 for certain convictions. Different exclusions, procedural requirements, and access rules apply. Juvenile records require their own analysis.

Review the Court File and the Report

  • Identify the court, docket number, and outcome of each charge.
  • Locate any prior expungement or sealing order.
  • Keep the background report or search result that still shows the matter.
  • Document relevant sentence and supervision completion dates.

If an order already exists, the problem may concern implementation or the particular source displaying the record. If no order exists, counsel must first assess the available legal route. A disappearance from one public search does not prove that every record has been sealed.

Access and Disclosure After an Order

Sealed does not necessarily mean destroyed or inaccessible in every circumstance. The governing law can permit later access for specified purposes. Review the specific order before answering a licensing, employment, or other legally significant question about the case.

A commercial report may require separate follow-up even after court records change. Preserve the date and source of the report and compare it with the order rather than assuming the court can remove every third-party reference.

Choosing the Correct Next Step

A record correction, expungement petition, and request to implement an existing order address different problems. Counsel can determine which issue is present, identify necessary records, and explain the limits of the requested relief. Record restriction is not a substitute for an appeal of a conviction or sentence.
