Exceeding Max Speed by 31 or More MPH

Have you been caught off guard by your speed, or were you in a rush to reach your destination? The flashing lights in your rearview mirror signal trouble, and suddenly, you’re pulled over. Now, you’re facing a ticket for exceeding the maximum speed limit by 31 mph or more.

For drivers in Uniontown and Fayette County, speeding tickets are not only an inconvenience but also bring serious consequences. These include hefty fines, points on your license, increased insurance premiums, and even the possibility of a license suspension. That’s why Logue Law Group is here to help. Our experienced Uniontown criminal lawyers will fight to reduce your penalties and, in some cases, eliminate them altogether.

Facts About Speeding

Speeding is strictly prohibited across Uniontown and Fayette County. If there’s no speed limit sign posted, you should follow these general guidelines for safe and lawful driving in the area:

  • Expressways: 55 MPH
  • Non-residential streets: 35 MPH
  • Residential streets: 25 MPH

To issue a speeding ticket, law enforcement typically requires you to be driving at least 6 MPH above the speed limit. However, in school zones, you can receive a ticket even if you’re just 1 MPH over the posted limit.

Exceeding the Maximum Speed by 31 or More MPH

Getting a ticket for driving 31 MPH or more over the speed limit is considered excessive speeding. If this happens, you will be required to attend a mandatory PennDOT hearing. Keep in mind that skipping this hearing will result in an automatic 60-day license suspension.

At the hearing, a PennDOT examiner could impose either a 15-day license suspension or require you to take a driving road test. Additionally, five points will be added to your driving record. With an experienced attorney from Logue Law Group by your side, you stand a better chance of reducing these penalties and protecting your driving privileges.

Ways Police Measure Your Speed

Law enforcement officers use several methods to monitor and measure vehicle speeds, including:

1. Pacing Your Vehicle

  • An officer follows your car and matches their speed to yours.
  • They must trail you for at least 3/8 of a mile before taking action.

2. Manual Speed Traps

  • Police use aircraft or other methods to track the distance your car covers. This data is then relayed to officers on the ground.
  • Manual speed traps often involve using a VASCAR (Visual Average Speed Computer and Recorder) device. However, these devices may be inaccurate for distances under 500 feet.

Important Note: You cannot be ticketed in zones with a speed limit of 55 MPH or less unless the VASCAR device confirms you exceeded the limit by at least 10 MPH.

3. Radar Guns

  • Only state troopers are authorized to use radar guns to catch speeders on the roads of Fayette County.

4. Automatic Speed Traps

  • Advanced systems equipped with transmitters are set up on both sides of the road to record vehicle speeds accurately.
  • The data is then sent to a computer in a patrol car.

Steps to Take if You’re Pulled Over

If you’re stopped by law enforcement for speeding, here’s how to handle the situation respectfully and confidently:

  1. Remain calm and polite.
  2. Avoid arguing with the officer or displaying frustration.
  3. Turn off your engine but remain inside your vehicle.
