Pants-less Woman Sitting on Bottle Faces DUI in Aliquippa

As a Pittsburgh criminal defense lawyer with a focus on DUI defense, I have represented many people who made poor decisions after drinking and deciding to drive.

Some DUI cases are cookie-cutter. Guy drinks a few too many at the bar, gets behind the wheel, and gets pulled over for blowing a stop sign or passing the center line a couple times. In other cases, DUI defendants smashed into police cars while intoxicated (some fatally), or fell asleep at the wheel.

I even know a client or two who decided to yell at police when faced with a field sobriety test or DUI charge, asking the cop if, in fact, “you know who I am.”

I have never, however, represented a client who was pants-less when they were pulled over and charged with DUI.

Which brings me to a story out of Beaver County.

According to local media reports, an Aliquippa woman is due in court for a preliminary hearing next month on a DUI charge, one that stems from an accident in the municipality from back in September.

Police said the woman – 33 – was still in the car when officers responded. The airbags were deployed in the accident (which is not detailed,) and she was naked from the waist down and sitting on a bottle of Black Velvet whisky. The bottle was open and empty. Now, if you’re like me, your mind makes pictures out of what you read, and I was having a difficult time with the sitting on the bottle thing. It sounds, though, like it was lying across the seat under her.

And to make matters worse, she refused to get out of the car, forcing officers to drag her from the vehicle – sans pants. Where were her pants? They were under the pedals. The driver kept saying she had left them at home, but the cops could see them on the floorboard.

The media reports indicate that she was then taken for a blood test at a local hospital, where she allegedly refused to cooperate and continued to refuse pants. It’s also been reported that she tried to kick a window out of the cruiser. I would assume that she had shoes on for that, despite lacking pants. There were no reports of foot injuries in the article.

While “don’t drive drunk” is always the primary lesson, and “always wear pants while driving” might be a secondary one, in this case, there is one more in the mix here: No matter how bad things are, you can always make things worse.

In the case of the pants-less Aliquippa woman, that means that not only is she facing a DUI, but also charges of open lewdness and resisting arrest, and disorderly conduct, among others. She’s going to be facing some pretty high fines and a lengthy stay in jail. She’ll have plenty of time to contemplate how it all went down.

And believe me: It’s difficult enough for clients to tell their parents, friends, significant others and co-workers that they’ve been popped for driving under the influence. You can imagine how fun it would be to explain why you were naked and sitting on a bottle when arrested.

Of course, since this story made it all the way to the New York Daily News, she may never live it down.
