Charges Reduced for a Former Client for a New Jersey DWI Case
DUI cases are among the most common types of cases we receive at Logue Law Group. So much so that some of our experts are always navigating the intricacies of local courts and keeping themselves updated with the latest precedents without fail.
A few days back, we received a call from a former client. He told us that he had been arrested for a DWI (DUI) charge in New Jersey and requested legal support. Thankfully, our Pittsburgh DUI attorneys were licensed to practice in New Jersey, and as a result, we took up the matter immediately.
So what happened next, and how did we manage a favorable outcome? Stick till the end of this blog to know it all!
The Incident
Our client, Mr. Thompson, was driving down the highway on the way home. He suddenly got pulled over by the cops, as they believed he was ‘swerving’ dangerously.
Now, Mr. Thompson was returning from his friend’s place, whom he visited after a long time. Naturally, he had a couple of drinks, but was completely in his senses. So, when the cops got a breathalyzer, he knew that he was going to face consequences!
And things turned out just as he expected. Although his B.A.C level turned out to be 0.09%, which is barely over the limit, he was charged and arrested for DWI.
Even though this was his first time, according to New Jersey laws, he was about to face the following consequences-
- Imprisonment up to 30 days.
- License suspension for 3 months.
- Fines ranging from $250 to $400.
- Installation of an ignition interlock for 3 months after suspension.
However, being a former client, our Pittsburgh DUI attorneys knew the person quite well. So, when he called us up and told us that he wasn’t swerving, we believed him and started to gather evidence related to the case, including the video of his arrest.
The Twist in the Plot
The moment we got our hands on the video, it turned the tables! That’s because the video clearly showed that our client was driving in his lane, and there were no signs of swerving!
After this discovery, our Pittsburgh DUI attorneys filed a motion to suppress because the cops lacked probable cause and lack of reasonable suspicion for stopping our client. In fact, the prosecutor examining the video also admitted that our lawyers had a strong case this time!
The Results
Based on all the evidence and arguments, the prosecution had a great alternative offer for our client. Since it was undeniable that he was drunk while driving, although there was no harm inflicted on anyone, our client got the DWI charges reduced to a reckless driving charge, which had minimal consequences under New Jersey law!
Our Pittsburgh DUI attorneys discussed this in detail with Mr. Thompson. He didn’t want to lose the trial and accepted this fair deal in exchange for a couple of points on his license and a minimal fine.
So, a charge that could’ve landed Mr. Thompson in prison got suppressed just because of the meticulous nature of our Pittsburgh DUI attorneys. That’s exactly why we at the Logue Law Group are so extensively popular in and around Pennsylvania.
