Expungement Granted for a Fleeing and Eluding Case
Recently, at Logue Law Group, we got a reckless driving case, which also involved fleeing and eluding charges.
Our client was out for a joyride on his motorcycle and got a bit too excited while driving on the I-76 freeway. What’s worse is the fact that he eluded some cops who tried to stop him, and continued his reckless driving until he got arrested.
The result? Well, our client faced an array of charges and was going to attract 5 points to his driving license, along with stiff penalties, a license suspension, and potential jail time. Luckily, he called our Pittsburgh criminal lawyers for help, and that’s where the case came to a turning point.
Fines and Charges for Speeding in Pennsylvania
Before getting into the case details, let’s just take a while and understand the fines and charges of speeding in Pennsylvania.
So, fines and penalties can vary extensively, depending on how far over the speed limit you were going. The base fine for speeding is $35. On top of that, an extra $2 fine is imposed for each mile per hour over the speed limit.
So, if you were going 15mph over the speed limit, your fine is: $35 + ($2 x 15) = $65.
Now, if you’re caught for excessive speeding, that’s considered a felony offense in Pennsylvania! For instance, if you’re driving 30 mph over the speed limit, you could face a reckless driving charge.
Now, reckless driving charges aren’t some minor infractions. They can carry hefty fines, suspension of your driver’s license, and potential imprisonment sentences. That’s exactly why you need a Pittsburgh criminal lawyer in such situations.
The Road to Expungement
Initially, the cops caught our client riding at 80 mph in a 70 mph zone. When they tried to stop him, our client reportedly vacated the scene and afterwards was caught speeding at 110 mph.
However, he didn’t get past the cops the second time! And upon his arrest, he was charged with-
- Fleeing and eluding.
- Exceeding speed limits by 30+ mph
- Disorderly conduct
- Improper passing
Initially, our client thought that he was done and dusted for his life! However, our Pittsburgh criminal lawyers studied his case and decided to approach the case differently.
We knew that our request to reduce the charges wouldn’t stand in court. And so, we did not play by that rule! Instead, our Pittsburgh criminal lawyers decided to seek leverage of the Accelerated Rehabilitative Program (ARD).
And that very decision led us to get the better of the case! What supported us was the fact that our client was a first-time offender! Therefore, proving him eligible to get into the ARD program was a cakewalk for our lawyers.
However, for our client, the ARD Program included the following-
- Serving six months of probation
- Completing 10 hours of community service
- A fine
Along with this came the most important part of the case. Once our client completed the whole ARD program, his case would be eligible for expungement. Which means, he won’t have any pointers in his license, and won’t have a criminal record. This would make it easier for him to move on with his life and his career.
That’s what our Pittsburgh criminal lawyers are trained for at the Logue Law Group.
