Felony Charges for a Domestic Dispute Reduced to Simple Assault
At Logue Law Group, we recently got a case involving a domestic dispute. At first, we expected the case to be like the ones that involve misunderstandings and heated arguments. However, when we heard the details, we were left shocked!
Our client, a young woman in her mid-30s, was cited with second-degree felony charges for severely injuring her live-in partner following a dangerous assault. If it weren’t for our Pittsburgh criminal lawyers, the woman would’ve had to face a substantial prison time!
So, what really happened, and how did we manage to extract a favorable outcome for our client? Follow this blog till the end to find out the answers.
An Altercation that Led to Stabbing!
We follow a basic rule at our firm- deeply investigating a case to find the real-world facts. And while doing so, we understood the actual reason behind our client facing felony charges.
The couple had been living together for two years, and lately, our client suspected that her partner was cheating on her. However, her boyfriend denied this suspicion outright whenever she confronted him.
On the day of the incident, our client got hold of her partner’s phone, and after checking his DMs thoroughly, she realized that all her suspicions were true.
As usual, she confronted her boyfriend again, which led to an altercation. However, things got pretty messy when the woman suddenly drew a kitchen knife and stabbed her boyfriend! The only fortunate thing about the whole scenario was that the man was alive. But he suffered a severe injury on his right arm.
After this, the man called the cops and filed a complaint against his partner. The cops charged her with aggravated assault. She was cited with a second-degree felony charge that came with a 10-year incarceration, along with $25,000 fine!
The girl, now realizing her blunder, called up our Pittsburgh criminal lawyers and begged us to take up the matter.
How Did We Resolve the Matter?
A felony charge can get quite serious, and in this case, our client was surely looking at quite severe charges. However, our Pittsburgh criminal lawyers didn’t lose hope and proceeded with our negotiation.
Knowing that a dismissal was way out of our client’s league, we negotiated to reduce both the charges- aggravated assault and possession of an instrument of crime- to a simple assault.
And here’s where a surprising thing happened, which even our seasoned Pittsburgh criminal lawyers didn’t expect! We thought that negotiating with the prosecution to withdraw such serious charges would be quite a difficult matter. But the results turned out to be quite the opposite!
The prosecution agreed to our appeal because our client had to plead guilty to a simple assault charge. Although the gravity of the incident would lead our client to face a second-degree misdemeanor, with a 2-year prison sentence, and fines up to $5,000, it was far better than the felony charges carrying stiffer penalties and a decade-long incarceration!
And that’s exactly the reason you need to hire a professional legal counsel, no matter how complicated or severe a charge you are cited with. At Logue Law Group, our Pittsburgh criminal lawyers get to the bottom of each case we handle and try to extract the most favorable outcome for our clientele!
