From Accused to Clean Slate: How We Ensured a Not Guilty Verdict for Our Client
We mostly handle mundane matters at Logue Law Group, but sometimes, out-of-the-ordinary cases come our way. Such cases contain so many plot twists that they even leave our experienced Pittsburgh criminal lawyers astonished!
This blog is about one such exceptional case, where every piece of evidence reflected that the accused was guilty. However, after we took over the case and took a deep dive, it was one of the most complicated labyrinths we ever encountered!
Let’s take a closer look.
The Incident and the Charges
Our client, Mrs. Williams (name altered due to confidentiality), suspected that her current partner was cheating on her with his ex-girlfriend. But she chose to keep quiet and observe until she got solid proof of her assumptions.
Unfortunately, her suspicion proved to be correct. She caught her partner meeting with his former girlfriend and decided to confront them. The confrontation turned out to be a heated debate, and our client allegedly slapped the victim and pushed her off balance.
Added to that, Mrs. Williams also confessed that she pulled out her gun and threatened the victim in front of her partner. As a result, she was accused of three charges-
- Simple assault
- Reckless endangerment (REAP)
- Possession of an instrument of crime
Now, the nature of these charges is quite serious and carries life-altering consequences! For instance, the least serious of simple assault charges is a third-degree misdemeanor, which carries the following penalties-
- An imprisonment sentence of up to 12 months.
- Fine of $2,500.
Not just that, but if you get convicted of this charge, your name gets permanently etched on the criminal records.
So, when our Pittsburgh criminal lawyers spoke to Mrs. Williams, they told her every little detail that she needed to know about the charges. And naturally, she did not want to get involved in this complex puzzle and requested us to get her a clean slate.
What Did We Do?
After hearing all the details, our Pittsburgh criminal lawyers studied the case, including the investigations, thoroughly. What was especially challenging was getting access to the witness interviews. But our years of experience and goodwill paid off in this case.
We found a crucial element that was enough to put the case to rest. Our Pittsburgh criminal lawyers discovered that the witness’s trial testimony did not match the statements in the recording of the witness’s interview footage. We placed this point during the trial, and the prosecution was compelled to rule Mrs. Williams not guilty!
You might be wondering whether or not such a small discrepancy would affect a case. But in reality, it does! Even the slightest of discrepancies can result in a complete turnover of a case, and this time, it was our experienced lawyers who took advantage of it.
So, in the end, the court ruled Mrs. Williams not guilty of all three of the charges being levied against her. Not just that, but the case also got qualified for expungement, which meant that Mrs. Williams could now move on with her life without her past overshadowing her prospects.
That being said, simple assault and REAP charges carry a lot of gravity and can turn your life upside down!
