Probation Secured for a Drug Addict with a Criminal History
Recently, at Logue Law Group, we handled quite a challenging case of a client with a prior criminal history.
Our client, a 38-year-old man, was charged with possession of paraphernalia. However, he happened to be a severe drug addict and had a prior criminal history, with a sentencing guideline.
Thinking all hope was lost, the man finally built up some courage and called up our Pittsburgh criminal lawyers. He briefed us on the whole scenario and requested us to dismiss the charges.
However, owing to his prior record, a dismissal was impossible. So, we approached the case from a different angle and helped our client secure a probation!
How so? Well, stick to the blog to find out.
A Case that Started from an Overdose!
As mentioned above, our client was a severe cocaine addict. And like every other day, he was immersed in his daily ritual when things went sideways. He overdosed on cocaine and suffered a major seizure. Things would’ve gone worse, but fortunately, his girlfriend dialled 911 immediately and asked for help.
Now, drug overdose cases always end up involving the cops, and this was no different from a scenario! When the Emergency Medical Services (EMS) and the cops arrived, the woman informed the police about her boyfriend’s addiction and the cause of the seizure.
Naturally, the cops went on to search the property and finally secured a crack pipe from the backyard. This was enough evidence to cite our client with possession of paraphernalia.
Thinking that all hopes were lost, our client finally gathered courage and called up our Pittsburgh criminal lawyers. He requested a total dismissal of the charges against him.
How Did We Resolve the Case?
Owing to the history of our client and the current charges against him, we knew that dismissal was out of the question! So, our Pittsburgh criminal lawyers thought of something better for the man- securing a probation.
But securing a probation, that too, for such a case, is easier said than done! The court showed little empathy for our client, and negotiating became quite a challenge. However, our Pittsburgh criminal lawyers didn’t lose hope and stood strong on their defense statements. We argued that a prison sentence would further break down our client and might even be the instigating factor behind his falling back into his past habits.
And after a long negotiation, the prosecution finally agreed to our terms! Our client, despite being cited with a serious drug charge and having an extensive criminal record, was granted to serve a probation period instead of serving a prison sentence.
This is one of the few cases where, despite our client’s earnest requests, we couldn’t help achieve a dismissal for him, which reflects that the outcome of a case solely depends on the factors and elements unique to that case. For instance, in this case, our client’s prior criminal history and addiction stopped us from moving for an appeal of dismissal.
However, what our Pittsburgh criminal lawyers secured was no less than a boon for our client! And sometimes, that’s exactly what you need to realize your mistake and mend your ways!
