The Fourth of July in Pennsylvania is a spectacle unlike any other. As the birthplace of American independence, several cities go all out with massive displays, backyard barbecues, and crowded celebrations. However, with the festivities comes a massive surge in law enforcement presence.

From July 3rd through the end of the holiday weekend, the streets are flooded with extra patrols and strategically placed checkpoints.   • Advance visibility: A sobriety checkpoint cannot be a blind trap. There must be adequate warning, usually in the form of signs and lights. This informs the drivers that they are approaching an inspection area. 
  • The brevity rule: The law requires these stops to be brief. If there are no immediate signs of intoxication—like the smell of alcohol, glassy eyes, or slurred speech—the officer is generally required to let you move along quickly. 

Your Right: What You Can (and Should) Do

Most people don’t realize that they have options when they see a checkpoint ahead. As long as you can do so legally and safely, you’re allowed to turn onto a side street or take a different route to avoid the checkpoint. However, making an illegal U-turn or swerving across lanes will give an officer reasonable suspicion to immediately pull you over. 

If you’re stopped, be polite but remember your Fifth Amendment rights. You’re required to provide your license, registration, and insurance. However, you aren’t required to answer trap questions like, “How many drinks have you had tonight?” You can respectfully decline to answer incriminating questions until you have spoken with a Pittsburgh DUI attorney.
