Trespassing Case Dismissed for a Senior Citizen
Recently, we at Logue Law Group handled a trespassing case that involved an elderly woman. The charges being levied on this woman could have easily led people to assume that she broke into someone’s property. But the case was different from what it seemed, and it was the meticulousness of our Pittsburgh criminal lawyers that resulted in a total dismissal of the case.
Let’s take a closer look to understand what happened.
A Tragic Downfall
So, our client, a 70-year-old woman, lived in her own home in Radnor Township for nearly four decades. She had a happy family with her husband and two children.
But unfortunately, life had other plans for her! Both of her sons (aged 22 and 24) died in a car crash that involved a drunk driver. And before she could come out of this emotional turmoil, fate charged her with another tragic incident.
A couple of months after her sons passed away, her husband suffered a cardiac arrest. And on the way to the hospital, he succumbed to his strain.
Now, with her husband and two sons gone, the woman could no longer afford to maintain the property and was literally forced to sell it. However, that was her home for 40 long years, where she lived happily with her family. Naturally, she got devastated, and chose to stay in that vacant place.
The Next Chapter
When the demolition crew arrived and was about to start their work, they found the woman inside the house, and called the cops immediately. The cops, too worked-up to even listen to the elderly woman, charged her with-
- Criminal trespassing.
- Burglary.
- Defiant trespassing.
- Criminal mischief.
Now, judging by her current situation, the woman’s bail was set at $1. But, she didn’t have anyone to pay, and therefore, had to stay behind bars for one month. After she was released, she immediately called our Pittsburgh criminal lawyers and asked for help.
What We Did
Upon getting the call, we immediately sorted out a plan of action and agreed to represent our client. So, at the preliminary hearing, when the prosecution offered an alternative adjudication program, our Pittsburgh criminal lawyers simply denied it.
Not just that, but we also argued that our client had been punished enough for something that she wasn’t even at fault for! We further argued about the string of tragic events that happened with her, and requested a total dismissal of the entire case.
After a brief negotiation session, the judge finally understood and decided to throw out the whole case. This means our client was now free to walk away! On top of that, she wouldn’t have to serve any additional prison sentence, pay no fines, and most importantly, would have no criminal record behind her name.
Such cases are rare, and time and again, serve as reminders for us lawyers to always approach every case with profound empathy. That’s why you will never find our expert Pittsburgh criminal lawyers at Logue Law Group judging the clients, no matter how complicated a case is. Our strict rule is to put the client’s demands first, for which we are prepared to defend even the strongest of charges.
