Carbon County Child Sexual Abuse Survivor Rights and Legal Options

Survivors of clergy or child sexual abuse in Carbon County may have questions about civil claims, filing deadlines, records, and whether an institution may share responsibility. The answer depends on the survivor’s age, when the abuse occurred, the identity and role of potential defendants, and the facts of each claim. This guide provides general information for survivors in Jim Thorpe, Lehighton, Palmerton, Lansford, Nesquehoning, and communities throughout Carbon County.

Experience representing Pennsylvania survivors

Sean Logue has represented hundreds of survivors of abuse connected to the Boy Scouts of America and children abused in Pennsylvania detention centers. That experience informs the firm’s work with survivors throughout Pennsylvania. Each potential case requires an individual review; prior experience does not determine whether a particular claim is available or its outcome.

What a civil investigation may examine

Depending on the facts, a civil investigation may consider the conduct of an individual and whether an organization had a legal responsibility to protect children. Relevant questions can include notice of prior misconduct, supervision, reporting practices, hiring or volunteer screening, recordkeeping, and responses to safety concerns. These are issues to investigate, not assumptions about any church, school, youth organization, detention facility, or person.

Potentially relevant materials may include institutional or personnel records, incident reports, correspondence, calendars, photographs, and public records. Survivors do not need to collect every record before seeking legal advice. Preserve original documents already in your possession and avoid altering or deleting them.

Pennsylvania filing deadlines

Pennsylvania law currently provides specific limitations periods for certain civil claims arising from sexual abuse. Under 42 Pa.C.S. § 5533(b)(2), a person whose claim arose while under age 18 generally has until 37 years after turning 18 to bring certain damages actions. For certain claims arising when a person was 18 but under 24, the statute provides until age 30. The statute’s definitions and application are claim-specific; other deadlines or legal rules may affect a case.

As of November 5, 2026, no general Pennsylvania lookback window has opened for previously time-barred childhood sexual-abuse claims. House Bills 462 and 464 remain proposals; proposed legislation is not an enacted filing window. Do not assume a future change will apply. A Pennsylvania attorney can review current deadlines for particular facts.

A lawyer can review possible defendants, applicable deadlines, records to preserve, and whether a civil case may be available. You may share only what you feel comfortable sharing at first. If a child may currently be at risk, contact law enforcement or the appropriate child-protection agency.
