Clearfield County Domestic Violence and PFA Defense Lawyer

A domestic-violence allegation in Clearfield County can create several urgent problems at once: a criminal investigation, a Protection From Abuse petition, restrictions on contact, and uncertainty about access to your home or children. Logue Law Group helps defendants understand the paperwork, prepare a response, and coordinate the defense when more than one proceeding involves the same events.

Our firm is based in the Pittsburgh area and considers representation in Clearfield County, including matters involving Clearfield and DuBois. For other charges, visit our Clearfield County criminal defense page. The first consultation should identify every pending case and the next deadline.

Criminal Charges and PFA Proceedings Are Different

A domestic dispute may result in a criminal allegation, a civil PFA petition, or both. A PFA proceeding addresses a request for protective relief under Pennsylvania law. It is not the same proceeding as a prosecution for an alleged crime. The evidence, issues, and potential consequences must be evaluated separately, even when the parties and underlying incident overlap.

Pennsylvania’s Protection From Abuse Act governs qualifying relationships, allegations of abuse, hearings, and available relief. A lawyer should review the actual petition and order rather than relying on a general description of the dispute.

What to Do After Receiving an Order

Read the entire order and comply with its terms while seeking legal advice. An order may address contact, residence access, children, or weapons. Do not assume that an invitation from the other person changes a court restriction. If the terms are unclear or create a practical problem, discuss the proper court process with counsel instead of arranging your own exception.

Provide your lawyer with the petition, temporary or final order, proof of service, hearing notice, and any criminal complaint or release conditions. Identify each hearing date and any immediate obligation. The Pennsylvania courts publish general protection-order information; your own documents control what you must do in your case.

Preparing the Evidence and Hearing Response

Effective preparation requires a reliable chronology. Record the dates of the alleged incidents, who was present, what communications occurred, and which records may help explain the events. Preserve complete message conversations, original photographs, existing recordings, and relevant documents. Do not delete unfavorable material, alter files, or contact the other party to obtain a different account.

Your lawyer can assess the allegations, identify relevant witnesses, review evidentiary issues, and prepare questions for the hearing. Context matters, but a dispute about a relationship or parenting arrangement does not by itself resolve whether the legal requirements for relief are met. Any parallel criminal investigation also requires careful consideration before testimony or other statements are made.

Alleged Violations Require a Separate Response

A claim that someone violated a protection order can lead to an additional proceeding. Section 6114 addresses indirect criminal contempt for violations of covered orders or agreements. The defense must examine the operative order, the alleged conduct, and the evidence supporting the accusation.

Save any new notice and tell counsel immediately about police contact or a claimed violation. Do not attempt to resolve the accusation by communicating with a protected person in a way the order prohibits.

Discuss a Clearfield County Defense

Bring all court papers and explain any related criminal, custody, or existing protection-order matter. Official court contact information is available through the Clearfield County court directory. Confirm the hearing location and instructions shown on your notice.

Logue Law Group can discuss the allegations, available responses, and preparation for court. Outcomes depend on the facts and applicable law; dismissal or a particular order cannot be promised. Call 412.387.6901 or contact us about domestic-violence or PFA defense in Clearfield County.
