A blood-test result can be important evidence in a Pennsylvania DUI case, but it does not resolve every issue. What You Need to Know

Blood testing for law enforcement is a search. Counsel should review the warrant, voluntary consent, or other claimed exception to the warrant requirement. Statutory implied consent does not by itself resolve whether a warrantless blood draw was constitutionally valid. Collection procedures and the laboratory analysis require a separate review. Relevant questions include:

• Collection and custody: Who drew the blood, what equipment was used, and how the sample was identified, sealed, stored, and transported?
• Laboratory procedures: What method, quality-control records, calibration information, and analyst qualifications support the reported result?
• Timing and interpretation: When was the sample collected, which statutory subsection is charged, and what does the result establish about the alleged offense?
• Preservation and independent review: Is a sample still available, and would a defense expert or independent analysis help? Availability and usefulness vary by case.

Refusal and license consequences: Refusal of a qualifying chemical-test request can lead to a civil PennDOT suspension separate from the criminal case. Refusing a warrantless blood test is not interchangeable with refusing breath testing or blood testing under a valid warrant for criminal sentencing purposes. Pennsylvania’s DUI law includes BAC-based, impairment-based, and drug-related offenses. An alcohol result below 0.08% does not automatically rule out an impairment allegation. Conversely, an officer’s conclusion does not by itself establish guilt; the prosecution must prove the elements of the charge.

For BAC-based charges, sample timing matters. The statute generally uses a two-hour period after driving or actual physical control and provides a limited exception requiring good cause and no intervening alcohol or controlled-substance use after arrest. Drug-related blood testing requires attention to the specific substance, reporting limits, prescription history, and the subsection charged. A prescription does not automatically defeat an impairment-based drug DUI charge. Any medical or scientific explanation should be evaluated against the actual report and other evidence.
