Pennsylvania Workplace Injury Lawyer

A serious accident at work can affect your health, income, family, and plans for the future. A workplace injury may also raise more than one legal question. Workers’ compensation is a statutory benefits system for covered job-related injuries and illnesses. In some cases, a separate civil claim may be available against a person or company other than the employer whose negligence or defective product contributed to the injury.

Logue Law Group evaluates serious injury claims involving potentially responsible third parties. Whether a civil claim exists depends on the specific accident, the parties involved, and the evidence. This page addresses potential third-party claims; it does not determine eligibility for workers’ compensation benefits.

When someone other than your employer may be responsible

A worksite can involve several businesses and individuals. Depending on the facts, an investigation may examine the conduct of:

  • A general contractor, subcontractor, or construction manager;
  • A property or equipment owner;
  • A manufacturer, distributor, or supplier of a defective machine or safety product;
  • A maintenance or repair company;
  • A staffing company or outside vendor;
  • A motorist or commercial driver who caused a work-related crash; or
  • Another company whose actions contributed to the dangerous condition.

The fact that an incident happened at work does not by itself establish that one of these parties is liable. The investigation must identify the relevant duties, conduct, control, product condition, and causal connection.

Work accidents that may require a third-party investigation

Potential civil claims can arise from construction-site falls, equipment failures, forklift or vehicle collisions, falling materials, electrical incidents, burns, machine entanglements, and other serious accidents. A worker’s injury may also involve more than one cause. Records from the site, employers, contractors, manufacturers, insurers, and treating providers may each answer a different part of the question.

A workplace fatality can raise separate questions for surviving family members. See our Pennsylvania wrongful-death information for an overview of claims that may be available after a death.

How workers’ compensation and a third-party case differ

Pennsylvania’s Workers’ Compensation Act generally makes the employer’s liability under the Act exclusive for covered work injuries. The statute also allows an injured worker or eligible family members to bring an action against a responsible third party. These are different legal paths with different defendants, procedures, proof, and potential forms of recovery. A third-party case may also involve a workers’ compensation subrogation claim under the Act.

No one should assume that a civil lawsuit is available in every work injury or that it replaces workers’ compensation. The facts and the parties’ legal relationship must be reviewed.

Evidence that may help explain what happened

Depending on the incident, useful evidence may include photographs or video of the location, equipment identification and maintenance history, incident reports, witness names, work assignments, contracts, inspection or training records, product manuals, vehicle information, and medical records. Some evidence can change or disappear quickly. If it is safe to do so, preserve copies of records and photographs and keep relevant equipment or documents intact. Do not put yourself at risk to gather evidence.

After an accident, obtain appropriate medical care and promptly report the incident through the required workplace process. Keep copies of communications, medical paperwork, and out-of-pocket expenses. Before signing a release or making detailed recorded statements about fault, consider getting legal advice about what the document or request covers.

Frequently asked questions

Can I bring a lawsuit if I receive workers’ compensation benefits? Possibly. Pennsylvania law permits an action against a responsible third party in some circumstances. Workers’ compensation and the civil claim are distinct, and a third-party recovery may raise subrogation issues.

Can I sue my employer for a workplace injury? The Workers’ Compensation Act generally makes the employer’s liability under the Act exclusive for covered injuries. Exceptions and unusual circumstances require careful legal analysis. A claim against a separate third party is a different question.

Who might be a third party? Depending on the facts, it could be a contractor, property owner, equipment manufacturer, maintenance company, vendor, or motorist. Naming a category does not establish liability.

What if the accident involved a truck or other work vehicle? A collision may involve a driver, carrier, vehicle owner, maintenance provider, or another party. Trucking crashes should also be evaluated under the firm’s Pennsylvania truck-accident resources.

Does this page provide workers’ compensation advice? No. This page addresses potential civil claims against third parties. Workers’ compensation benefits are governed by a separate statutory process.
