Pennsylvania filing deadlines
Under 42 Pa.C.S. § 5533(b)(2), a person who was under 18 when a civil claim arising from sexual abuse accrued generally has 37 years after turning 18 to bring a damages action. The statute separately addresses people who were at least 18 but under 24 when the cause of action occurred, allowing suit until age 30 in circumstances covered by the law. How those provisions apply depends on the facts, the claim, the defendants, and law in effect at the relevant time.
Other time limits may apply. 42 Pa.C.S. § 5524 provides a two-year limitation for specified actions, but it is not a complete deadline analysis. Accrual, tolling, the identity and legal status of a defendant, and other rules can affect an individual matter.
Has Pennsylvania opened a retroactive lookback window?
As of November 5, 2026, Pennsylvania has not opened a retroactive civil filing window for claims that were already time-barred. Proposed bills do not create a filing period. Survivors should not assume that a claim is timely or barred based only on age or an online summary. A lawyer can review the facts and current law.
