Pennsylvania Criminal Record Sealing Lawyer | Limited Access

Many people call it “sealing,” but Pennsylvania generally uses the term limited access for procedures that restrict public access to qualifying criminal records. Limited access is legally different from expungement: the record is not erased, and statutory exceptions still allow access by certain agencies or for specified purposes.

Pennsylvania limited-access options

Depending on the case, relief may be available through a petition under 18 Pa.C.S. § 9122.1 or Clean Slate limited access under 18 Pa.C.S. § 9122.2. The applicable route turns on the offense, disposition, dates, record history, and statutory exclusions. Some records may qualify for automatic treatment; others require a petition. An eligibility review is necessary before anyone can say which applies.

Limited access does not guarantee that every employer, licensing body, law-enforcement agency, or government office will be unable to see a record. The statute contains exceptions. We explain what an order does and does not cover before taking action.

How a limited-access review works

  • Review the docket and exact disposition for each charge.
  • Check whether the record is eligible under the petition-based or Clean Slate provisions.
  • Confirm any required waiting period, sentence completion, restitution, and disqualifying record.
  • File a petition when required and address any hearing or objection.
  • Verify the court order and explain how to answer future background-check questions.
