West Virginia Criminal Record Expungement Lawyer
West Virginia law provides several paths to expungement, but the available remedy depends on the case outcome and offense. Some nonconviction records may qualify after acquittal, dismissal, deferred adjudication, or successful pretrial diversion. Certain misdemeanor and nonviolent felony convictions may also qualify if statutory requirements and waiting periods are met.
West Virginia expungement laws
West Virginia Code § 61-11-25 addresses specified nonconviction, deferred-adjudication, and pretrial-diversion records. Section 61-11-26 governs expungement of certain convictions, including qualifying misdemeanors and nonviolent felonies, subject to exclusions, waiting periods, and court review. Other statutes may apply to particular matters.
We review the final disposition, full criminal history, sentence and supervision completion, and statutory eligibility before preparing a petition. The court may require a hearing and review records from law-enforcement or supervision agencies. No expungement is guaranteed.

What to bring
