West Virginia Criminal Record Sealing Lawyer
People often search for criminal record “sealing” when they want a past case hidden from public view. West Virginia’s rules are statute-specific: for many eligible criminal convictions, sealing is addressed within the statutory expungement process rather than as a separate, unrestricted petition to seal any record.
What West Virginia law provides
West Virginia Code § 61-11-26 governs expungement of certain misdemeanor and nonviolent-felony convictions and defines sealing within that framework. The statute sets eligibility limits, waiting periods, exclusions, and court procedures. Nonconviction records and successful deferred adjudication or pretrial diversion may be governed by § 61-11-25. An expungement or sealing order is not available in every case, and some authorized background checks may still access records.
Why the distinction matters
The requested outcome must match the legal route. A case dismissed before conviction, a misdemeanor conviction, and a nonviolent felony conviction can have different procedures. We review the disposition and complete record before advising whether expungement, sealing as part of expungement, or another remedy may apply.
