Maryland Social Media Injury Claims: Law and Filing Deadlines
A possible social media injury claim involving Maryland requires more than a general deadline found online. Logue Law Group reviews the facts, potentially applicable law, and available evidence before advising a family about options. Seek advice promptly rather than waiting for a national lawsuit or another family’s result.
General Limitation Rules
Maryland Courts and Judicial Proceedings § 5-101 generally provides three years from accrual for a civil action at law unless another Code provision sets a different period. Section 5-201 addresses causes of action accruing in favor of minors and persons within its specified disability category, including a lesser-of-three-years-or-applicable-period rule after the disability is removed and an exception in subsection (b).

A General Three-Year Rule Is Not a Personalized Deadline
The date a cause of action accrues, the person who owns the claim, and any special statutory provision matter. A parent’s inquiry should not be treated as automatically preserving a child’s rights or the parent’s separate rights. Explain any prior filing, settlement, representation agreement, or communication that mentions a deadline.
Information Needed for a Deadline Review
- The young person’s date of birth and age during relevant events, discussed privately.
- Approximate dates of platform use, first observed symptoms, professional evaluation, and treatment.
- Where the person lived and where relevant events occurred.
- Any prior lawsuit, settlement, representation agreement, or known deadline.
- Which person is seeking recovery and the injuries or expenses claimed.
Label uncertain dates as estimates. Do not change records to make a chronology appear more precise. Contacting a law firm or requesting account data does not itself file a lawsuit or suspend a limitation period.
State Law and National Proceedings Serve Different Roles
A coordinated federal proceeding does not eliminate the need to analyze state law or prove an individual injury. The attorney must examine available causes of action, applicable defenses, causation, and damages. The nature of the alleged platform conduct matters; a dispute about a third party’s content can present different issues from an allegation about a platform’s own design or warnings.
Local Records and the Proper Court
Maryland inquiries may involve Garrett County and Deep Creek Lake, Baltimore City, or communities elsewhere in the state. List periods of residence and care, including treatment in Pennsylvania or West Virginia. Baltimore City is a separate jurisdiction from Baltimore County; accurate locations help counsel review the facts.
Start with the Maryland social media injury overview and local directory. The parent resource center explains how to organize a record inventory without sending sensitive files through a public form.
