Pennsylvania Social Media Injury Claims: Law and Filing Deadlines

A possible social media injury claim involving Pennsylvania requires more than a general deadline found online. Logue Law Group reviews the facts, potentially applicable law, and available evidence before advising a family about options. Seek advice promptly rather than waiting for a national lawsuit or another family’s result.

General Limitation Rules

Pennsylvania’s 42 Pa.C.S. § 5524 generally supplies a two-year limitation for personal injury actions. Section 5533(b)(1) generally excludes the period of minority when a claim accrues to an unemancipated minor and defines a minor as someone under 18. Those provisions are starting points, not a deadline calculation for a particular family.

Primary sources: 42 Pa.C.S. Chapter 55. Statutes, exceptions, and court interpretations must be evaluated together. This overview does not calculate or extend your deadline.

Do Not Combine a Child’s Claim With a Parent’s Deadline

Identify whose injury and expenses are at issue. A rule protecting a minor’s own claim should not be assumed to preserve a separate claim belonging to a parent or another person. Tell counsel whether the young person was emancipated, moved between states, or has already reached adulthood. Do not assume that a later diagnosis, a news report, or continued app use automatically restarts the clock.

Information Needed for a Deadline Review

  • The young person’s date of birth and age during relevant events, discussed privately.
  • Approximate dates of platform use, first observed symptoms, professional evaluation, and treatment.
  • Where the person lived and where relevant events occurred.
  • Any prior lawsuit, settlement, representation agreement, or known deadline.
  • Which person is seeking recovery and the injuries or expenses claimed.

Label uncertain dates as estimates. Do not change records to make a chronology appear more precise. Contacting a law firm or requesting account data does not itself file a lawsuit or suspend a limitation period.

State Law and National Proceedings Serve Different Roles

A coordinated federal proceeding does not eliminate the need to analyze state law or prove an individual injury. The attorney must examine available causes of action, applicable defenses, causation, and damages. The nature of the alleged platform conduct matters; a dispute about a third party’s content can present different issues from an allegation about a platform’s own design or warnings.

Local Records and the Proper Court

Pennsylvania families may have treatment and school records in different counties or in neighboring states. List the actual locations and dates. A page for Pittsburgh, Philadelphia, Erie, or another community does not establish venue or promise that litigation will occur in that county.

Start with the Pennsylvania social media injury overview and local directory. The parent resource center explains how to organize a record inventory without sending sensitive files through a public form.
