TikTok Social Media Addiction and Injury Claims
A TikTok injury inquiry should identify the account, periods of use, and the specific experiences the family is concerned about. Screen time can be a useful starting point, but it does not by itself establish what a young person saw or whether legally actionable conduct caused an injury.
Build a Timeline Without Recreating a Feed
Write down when the young person began using TikTok, whether more than one account was used, and when the family noticed significant changes. Preserve existing reports or communications and identify the dates they cover. A present-day feed may differ from an earlier experience; recreating harmful searches or repeatedly viewing distressing material is not an appropriate evidence-gathering exercise. Record gaps honestly.
Records to Discuss With Counsel
- Account names, approximate starting age, and known changes of device.
- Existing TikTok data exports, platform notices, or support responses.
- App-specific use reports, distinguished from total phone screen time.
- Relevant treatment dates, attendance changes, and other events during the same period.
Using the Platform’s Official Data Tools
TikTok’s official support resources include a request-your-data process. Use the current in-app instructions for an account you are authorized to access. Save the original file, request date, and any notice about unavailable information. Do not assume an export includes every video recommendation or every historical interaction. See the official data and account guidance.
Allegations Are Not Findings of Liability
The October 24, 2024 federal school-district order describes compulsive-use allegations involving TikTok. That order addresses a different plaintiff group and does not prove an individual family’s claim.
Legal review must address the actual conduct alleged, the documented injury, and other potential causes. The existence of national litigation does not automatically include a particular user or guarantee compensation. Current case-specific orders and applicable state law must be checked.
What if the TikTok account is no longer available?
Tell counsel what happened and when. Preserve existing files and correspondence. Missing account access does not justify guessing passwords, impersonating the user, or bypassing restrictions; counsel can evaluate lawful options.
Health care remains the priority. Do not delay treatment or continue harmful exposure to build a claim. Our parent resource center provides a practical starting point.
